Home Information Kit: A set of documents containing legal and official information about a home, provided by the owner to a person interested in buying the home. I am sometimes asked how explicit a judge must be in determining the “time or intervals” at which a special conditional sentence will be served. Form AOC-CR-603, page two, page one, gives the court the ability to prescribe a specific day, date and time for the defendant to report to the prison, possibly at regular intervals for a specified period of consecutive weeks. The form also allows the court to order that the “sentence be served on the direction of the probation officer within a specified period of days or months after receipt of the judgment.” Can the court go further and say that the probation officer can provide for a custodial sentence “as necessary” — at the officer`s discretion — to respond to wrongdoing by the offender? A HIP consists of five components: a HIP index, which explains exactly what is included in the information package; an energy performance certificate that assesses the energy efficiency and environmental compatibility of the property; a sales statement containing legal information about the ownership of the website; a research paper that contains information on issues related to the home and local authority, such as water, drainage and planning proposals nearby; and proof of ownership proving that the seller actually owns the property. The rules for sentencing an accused to a special conditional sentence – a shared sentence – are set out in G.S. 15A-1351(a). It is up to the court to decide. G.S. 15A-1344(e) sets out essentially the same rules for special conditional sentences that are ordered as a change of probation in response to a violation. I am not aware of any jurisdiction in North Carolina, but the Attorney General`s Council agrees with the decisions of courts in other states. For example, the Nebraska Supreme Court eliminated a provision that allows a probation officer to “waive” some of the days of probation imposed on a defendant. Staat v. Lee, 237 Neb. 724 (1991). The court ruled that the verdict was invalid, noting that “in probation cases, jurisdiction to detain offenders or release offenders from prison rests solely with the court of first instance.

The prison sentence must be pronounced by the judges. The court of first instance may not delegate to a non-judge the power to impose a custodial sentence or to quash a custodial sentence. Id., p. 725. The Illinois Court of Appeals reached a similar conclusion in People v. Thomas, 217 fig. App.3d 416 (1991) (“Although it is clear that the court intended to release the remaining 30 days of detention after the defendant successfully completed the program, it left it to the probation department to decide whether the defendant could be considered successful. It was not a function that could be properly delegated when the issue of extension of detention was at stake.
